Establishing a shell real estate brokerage does not qualify for Section 8(c)(3) exemption. Brokers must pay referral fees to other brokers in brokerage capacity. Anyone who says otherwise is either uninformed, or trying to defraud you. Never, ever use any referral agent-matching services that take a % of your agent commissions – they are all banned by RESPA. Only genuine brokers can take of give a referral fee to another broker.
